NEW VEHICLE WRITTEN OFF LAW

Not sure if anyone has had this problem yet as law is so new 31st jan

My bike of 3 years, much beloved and customised has technically been written off due to a guy pulling an illegal u turn in front of me, its due to high original parts costs $14000 quote, i was paid $8500 by insurance for my 2002 bike only 27000kms on clock though... and i really want to fix it as i could not possibly replace what i had for $8500

But because i cant tick any of the boxes (high market value, low production run, first or last in a production run, inherited, owned for 5 years, member of a club) for an application to have it re registered it might just end up as parts

I think my only chance is the member of club.....but i only registered today, been meaning to do it for a while though never did.

NRMA and the mechanic are giving me letters to state its only cosmetic damage and no structural damage has been sustained but i fear the pen pushers at rta will only see it black or white

if the powers at be might be reading this can you advise if you can help re my very recent membership and if possibly upon my further proof of my ownership that some help can be given to a felllow Haybusa lover in DESPERATE need of HELP

I'd get another quote ? It appears pretty high for only cosmetic damage If it's a repairable write off then buy back the wreck from insurance company ?

prob is rta sent me a letter saying rego is suspended as its a stat writeoff and insurance has paid me the money, i only wish there was a way my membership could be backdated with the club, then i could tick that box and put in the application for re registration, i just cant think of anyone i know in the club.

Firstly I would argue with the insurer that the amount paid to you does not represent the market value of the bike considering the aftermarket parts that have been fitted. If you have receipts then supply those in support of your case, if not - down load written quotes for the same new aftermarket parts.

As Faster said your best option is to buy the wreck and get another busa to transfer the parts onto. I dont think you will have much joy with the RTA sorry to say.

cant see how being a long time member of a club could possibly help you. this isnt a formally registered club, rather an internet based meet and chat with a website.

thats why i told all witnesses not to call ambos or police wen i had my accident, dont want insurance involved, at the end of the day, u can get most cosmetic parts for less than an insurance excess anyway, my stack was at 140k's and so far i recon i could get it back to the way it was for around $1500, but because of the accident, and having to replace all the farings and stuff anyway, gives a great excuse to customize it ;)

In the FAQs for WOV dated Jan 2011 there is a "special" provision for motorcycles which states that

"if you have a motor bike that was written-off on or after 31 Jan 2011 with non structural damage, you can apply to the RTA for Authorisaton to Repair.

It appears you dont need to fit one of the exempt categories

Mate I sympathize with you but you need to have a good look at what you wrote and wake up,you're publicly asking a club to falsify your membership for you to produce to the RTA and make a fraudulent statement by ticking that box.Secondly you're advertising your speed after being involved in accident, no matter if you injured yourself or others.Dude

These temporary provisions apply to motorcycles that have sustained cosmetic damage only, and no structural or non-repairable damage.

Before the motorcycle is eligible for exemption, the insurer must provide the RTA with the following information, in addition to the information provided to the WOVR:

Documentary and photographic records of the damage that resulted in the motorcycle being presented for a vehicle damage assessment
A written statement from the insurer that the motorcycle is structurally safe.

A customer can only seek to register an exempt motorcycle if the customer bought the motorcycle from its insurer."
