Good Morning, had a bit of a fender bender - ( someone side scraped me on my bike.
need to know how to determine whos fault it is - technically!.
In general - the guy didnt bother to see on his left and wanted to move in quickly as he had a Suburu STi.... - just a line on my right mufler nothing major but looks like a soup
Never been in a accident.......till now - hence the worry.

It looks a lot like his fault if he came across onto you and you were holding your line within the lane markings. I'm not a lawyer and you probably should get some better advice though.
mark stenberg is a motor lawyer hes also a big contributer to rapid mag speak to him hes got me out of shit once or twice mate he will know what you need to do
You might have to cop it on the chin Bill...you would need to prove that he crossed into your lane (assuming you stayed in your lane), and damn sure the Subaru driver won't admit it. If you've got his rego, track him down and spray a can of expanda foam up the tailpipe ...ooops, did I say that out loud.....
Whats your excess and how much would premiums increase and whats the cost of a as new s/h muffler (or replacement if its aftermarket)
for a minor scratch if you can't get him to sort it out easily just look at what it could cost to chase it up.
i understand the principal of the other guy f****d up and you could be wearing it but be carefull how much principals cost
Thank you guys, will see how the call with the insurance goes. I wasnt planning to put a claim as I am changing the pipes in Sept, but the Sti bloke wants to go to Insurance. so lets see how it comes up

If you're very convincing/lucky/cunning, you may be able to persuade the other party to realise and admit that he/she is "entirely" at fault (a subtle mention that you have an 'independant' 3rd party witness would definately help strengthen your case)!
If the other party is prepared to concede that, you will be able to claim on his/her insurance to cover your costs....and you'll save yourself a LOT of headaches (and $$$).
If the other party isn't prepared to admit fault entirely, and the damage to your vehicle is indeed as minor as you say, it just might not be worth your while claiming on your own insurance policy (excess $ ??? and possible(?) rise in future premium payments/excess fees)......or using lawyers, etc.
