Current court case regarding people smugglers

Both Labor and Liberal parties are quietly getting together to pass legislation to scupper a current court case where some do-gooders have presented a strong case to get a 'people smuggler' off scott free.

The defence's case is that the man on trial is not a people smuggler because as I've said here before, asylum seekers are not illegal immigrants and all an asylum seeker has to do is arrive at a country where they intend to seek asylum. As we're a huge island located at (quote) the arse end of the Earth, travelling by land is not an option so arrival is by sea or air - I'll get back to those who arrive by air later, but a boat crew is currently just facilitating the arrival of asylum seekers. That's a likely winnable defence.

The new legislation is very, very carefully being constructed because it will go against some of the refugee protocols we have signed up to and continue to say we accept. Someone will now become a people smuggler if they bring anyone to Australia who does not have a visa. If those people are later proved to be asylum seekers, it won't matter because the lack of a visa is what will be crucial. It will also be retro-spective legislation and apparently allow for prosecution of up 350 dudes, no dudettes.

This PROVES both parties acknowledge that boat people are NOT illegal immigrants. After processing, the ones who have no right to asylum are ejected from the country, but their previous status as aslylum seeker is completely above board. However, without a change in legislation, I'm telling you it would be impossible to convict a boat crew member as a people smuggler when the above defence is presented. As soon the legislation is rushed through, the current court case will end as the defence lawyers say it will instantly become unwinnable, so job done and 1 up to the Pollies.

Morally it's dodgy, but I won't get heavily into that because I believe in the notion of soverienty, but no matter what side of the argument you come from, visa carrying asylum seekers is really Eddie Izzard funny, isn't it? That said, that is how those coming in by air do it, so we're probably saying we only want a certain type of asylum seeker here - one who comes in on a plane, with a visa and is less visible to the media.

There are only TWO ethically correct options when it comes to asylum seekers. Sign the document (as Australia has done) take your fair share and process them humanly, in the community as we always have done with those flying in. OR;

Take the signature off the document and accept no one who claims asylum, lock them up as illegal immigrants (which they would be) and accept any consequences that come along with Australia's new placement in the World.

If you favour the second option, NONE of the current parties offer it, so stop talking up one side over the other and get on your local MP's back or start your own party. Either way, stop blaming asylum seekers - all problems with this, start at home.

This whole issue is a consequence of the race to the bottom of both parties.

They are more interested in pacifying rasict voters than any human rights considerations.

It was ever thus.

Dont think this issue will ever be resolved. There are so many reasons to jump the immigration queue and come over here by boat, the benefits are outrageous. The legal system helping them makes a lot of money for them and its an easy job, this is one easy ticket to freedom.
What happens down the track as a result of all this will be all of our faults, we didnt do something sooner about it. If you read the posts people are responding to in newspaper articles about the boat situation , majority are not happy with what is being done about it, now this.

Officially, under both parties, these numbers are way, way waayyyy under 5%. Now that might be a problem with naff processing (I don't know), but genuine asylum seekers shouldn't be thrown in with that immigration argument.

Here we go again with this argument, 5% under sounds good and makes me at peace with this whole thing, but when a few bad immigration detainees get together and set fire to detention complex buildings, refuse to come down off roofs, police guards and watches occuring costing millions upon millions, then get a visa a result. Others arriving by boat then have no accomodation left as a result, the remainder with no place to go get $400 a day hotel stays waiting for their immigratations to process. Now some get $1,000,000 + as a result of stress, plus free housing, geez will someone in the government wake up, this is big money from us taxpayers! 5% or not, its enough to cost big $$$$$ to everyone of us.

I have just had the priveledge of looking after the 12 that rioted on Christmas Island, and a couple from Villawood. The amount the federal government spent on these 15 would have exceeded 5 million in the 6 weeks we looked after them, and in the end only 5 of them got sent back to Iran. Most of them had been here illegally before, some up to 4 times.
They are a managerial nightmare, they threaten self harm to get what they want, which works when they were with imigration, but we strip em and lock them in a camera cell with nothing but a concrete bed. They bang on their cell doors 24/7, and yell abuse all day, and it is an effort to not smash the f*** out of them. They had access to 24 hour medical, international calls, welfare, psychs, doctors, even education.
I have mates that work at Villawood and they say it is worse there, they do as they please and if the gaurds try to stop them going somewhere they shouldnt they get assaulted, they spit, and throw piss and shit on officers every day. The public doesnt hear of any of this untill they are on a roof top where a camera crew can film them.
Im not sure what the solution is to this crap, but what we are doing now certainly isnt working. Perhaps we should just open our borders and let them all in, stipulate where they have to live to boost our country town economys, but not give them access to welfare payments for 5 years, and no medicare for 2. If they are convicted for an offence punishable by more than 2 years gaol send em home. Basically make them earn their keep.
I have a mate who married a girl from Taiwan, she had to jump through hoops to become a citizen, for 2 years she had to pay every time she went to the doctor, wasnt entitled to welfare payments. Perhaps we should be doing this to the illegals, and not the fair dinkum ones.

It would help if it was acknowledged that an asylum seeker ceases to be such when they have removed themselves from danger i.e. they arrive in another country.

At that point they become an economic refugee, as they are seeking entry to a country of choice. They are just like people from Europe, Africa, Asia etc. who have to go through all the hoops of immigration, but who are often denied visas for all sorts of reasons.

People seeking entry by boat from Indonesia etc. are deliberately attempting to circumvent the legal measures put in place to stop illegal entry. The airlines would not allow them to board an aeroplane to Australia.

Ask yourself one question: How do they get to Indonesia before they get on a boat ?
Simple. They fly into Jakarta's airport. Fold 3 x US$100 notes in half & put in their passport. The Indonesian Immigration Officer slips the notes "under the table", stamps their passport, (been there, done that Wm) and off the "refo" goes to get the next boat.
Now Kevin Crudd, being the current Foreign Minister of the Convicted Drunk Driver Living In The Lodge Labor Government should sort this shi* out, but we all know he won't because that Lesbian Chinese/Malay bitch Penny Wong's Malaysian family will miss out on too many ATP funded kickbacksWelcome

...and what the hell is Kevin Crudd as Australia's current acting Foreign Minister of the 4 x Over The Legal Blood Alcohol Limit Convicted Drunk Driver Living In The Lodge Labor Government doing having stupid little meetings in Canberra when we all know the ATP's total waste of money should be in Indonesia hammering the Indonesian Immigration Department/Government to stop this bullshi* that's been going on for years. We all know that if a foreign national turns up at an Aussie Airport without ligitimate reason for travel he/she is put back on a flight and sent back to where he came from immediately. Problem solved.
