Hi Guys,

As some of you may be aware i got knocked off my bike 2 months ago. Now the person is playing silly buggers and they haven't/won't pay their excess to their insurance company. So I stuck with a damaged bike and my dick in my hand.

Is anyone on here a solicitor in Sydney that can help with a letter of demand? I'm quite willing to take them to court.

And before you ask, my insurance payment was a day late and they said that technically I was uninsured at the time so I can't claim through them. Eventhough it's not going to cost them a cent...

Any help/advice would be appreciated.

Who is your insurance comapany mate? if i dont or forget to renew my insurance premium and i have an accident within one month of it expiring all i have to do is pay the insurance for the year and the excess and they treat me as if im still covered.

Hi John can't help you out with legal advice but would have to agree with Dan85.

With some insurance companies you have at least 14days after the expirey date to pay your premium and in some cases as Dan mentioned up to a month depending on who you are insured with. I would be checking with your insurance company again as well because it doesn't sound right from what you are saying.

I contacted my insurance company (Shannons) this morning and posed that question and they basically told me that as long as I pay the premium for the next 12 months they would cover me unless it's due to other reason for the accident like maybe drunk at the time.

Anyway hope you can make some head way with the situation.

Why did you not lodge claim 2 months ago and name your insurance company they suck most companys would send you out a reminder giving you at least 7 days to pay Undecided

I've done a Letter of Demand myself and sent it with Registered Mail. Didn't need a solicitor.
Just do it... PM me if you want an email of a template...

As above, preferably use a lawyer if they play silly buggers. Got hit by this major idiot years ago, some so called company director who told my insurance co that he had no money and could not pay for writing off my new car. They got a lawyer and lo behold, he had big bank balance that he forgot about. Funny that.

I had that done to me once-applies to the last sentence only. One minute you have the dollars, next you don't. Fortunate enough to take measures in time to prevent success of next attempt.Undecided
