Hi Busakhane. I'm not an experienced rider but I am experienced when it comes to taking on cops (I can't stand 'em); what state were you in when you were booked and they took the happy snap of the Busa? I don't think that what they were doing was legal and you can make an application under Freedom of Information legislation to see just what that state's police service has on you and your Busa and ask what they intend to do with it (this shouldn't fall to the same category as crown privilege). To my mind, all they were doing was exercising their common law right to take the photo and you could have exercised your common law right to refuse to allow it - there's nothing they could have done about it since you were only being issued with a fine for an infringement and not actually under arrest. As such, they were breaching your rights for not having explained any of this to you.
I loathe coppers who think they know it all when in actual fact they are infringing our rights as basically law abiding citizens, trying to have some harmless fun on our bikes and not out there doing something about REAL criminals!!!!!:"> :"> :"> If all they want to do is collect revenue, they should join the ATO!!! Jules - always smiling, it keeps everyone guessing!
