It's legal to pass in the left lane if the driver in the right is under the speed limit. The driver in the right lane could be looking for a turn off or just thinking they are doing the right thing by holding up the traffic to below the speed limit. It is required to indicate intension to change lanes.

Buggso , i think you should delete your posts mate , as legend suggests , you were not going to overtake up the inside as its illegal to do so, and to admit to it, admits liability.you were moving into the correct lane and the offending vehicle failed to see you / look in her blonde(blind) spot then collided with you ..
