Loophole in wheelie law?

Was chatting to a few people at the Road Warriors yesterday and someone mentioned that they had got off a wheelie fine because they werent speeding and he proved to the magistrate that he was in control of the bike the whole time - apparently there is a loophole regarding the speed issue, as long as you do it under the posted limit you can get off

I feel its right that if you can prove to the magistrate you were in full control and there were no other possible or associated dangers your home free, and rightfully so, well done Ruffy.
