Public fora and the law - Monyx - 03-08-2007 Just a timely reminder, it is regarded in Australia that a defamatory matter is defined as published matter which tends to: * adversely affect the reputation of a person * deter others from associating or dealing with a person * expose a person to ridicule, or * injure a person in their occupation or financial standing. Yes there are defences based on truth, public interest, contextual truth etc., but it rapidly gets expensive and/or consuming explaining yourself through the proper channels. It doesn't help that there is no single piece of legislation that covers this. RE: Public fora and the law - BLACKZOOK - 03-08-2007 f*** off you unemployable - retarded -gay -hermaphrodite. Does that qualify monyx???? ![]() ![]() RE: Public fora and the law - simmo - 03-08-2007 Not that's there's anything wrong with that ![]() RE: Public fora and the law - Astro - 03-08-2007 Hmmm... might want to check contract law too, especially the bit about breach of contract. One party might find that they receive $1 compensation and are then counter-sued for many thousands. If an offer is made publicly, contract law still applies. The court then determines if a 'reasonable person' would have expected delivery prior to the time of raising the suit. All in all, no-one really wins such actions, except the lawyers. It causes bad blood and ruins friendships. RE: Public fora and the law - pan - 03-08-2007 BLACKZOOK Wrote:f*** off you unemployable - retarded -gay -hermaphrodite. RE: Public fora and the law - Holger the Dane - 06-08-2007 The other unfortunate thing is that, in order to defend yourself, you have to shell out your hard earned.. Just as you all said.
