Just thought i'de get my legal question in also.I got booked for this offence a couple of years ago(and wore it):"> What is the ruling on overtaking on double lines?I was travelling up a hill, behind a car, when the car moved over enough to the left for me to overtake him,(without speeding)and without crossing the double lines.Anyway at the top of the hill was a cop who saw the incident and booked me for overtaking on the double lines.I argued that i did not go over the lines and he said it doesn't matter, you over took on double lines and thats breaking the law. What gives,IS THIS CORRECT?

Firstly to Johno..VicRoads may not want your actual licence for that short period of time...they have enough trouble with paperwork as it is..doesn't mean you're not suspended though..best to play it safe.

Rod , let me get back to you. My initial thought is that it's no different to say passing a parked car, but then I think it's illegal to park opposite double lines too..let me look it up and give a more certain answer. To the last I will grapple with thee; from Hell's heart I stab at thee; for Hate's sake I spit my last breath at thee.

Re: Another question for bluecenturion - demeester - 28-04-2003

Rod - I think you've been had. The offence which was cited to me was Quote:drive on or over on to the right of double lines

Re: Another question for bluecenturion - bluecenturion - 28-04-2003

Rod..demeester is correct..that is the correct wording of the charge..however..that relates to any part of the vehicle/rider. Without knowing the full story...if say this happened on a right-hand bend and part of the bike/your body was actually seen to be over the lines, then the offence would be complete and a ticket would be justifed (harsh, but true). If however it was on a straight bit of road, and no part of you or your bike crossed the lines, then you've been bluffed.. To the last I will grapple with thee; from Hell's heart I stab at thee; for Hate's sake I spit my last breath at thee.
