Filtering in Brisbane - Champs - 06-03-2009
Hello to all,
A warning to those traveling into Brisbane during busy times to watch out. Two days in a row now I have seen riders pulled over as you come into Brisbane from the north (opposite servo/HJ's) for moving through traffic congestion. The first time looked organised. They were hiding in the bushes with a bike and highway patrol car.
Looks like they are taking the recent rule change to target this out for a test run.

Have seen them a few times on Mt Lindsey Hwy at parkinson getting bikes up the in side the stand behind tree and jump out and stop rider

I know overtaking on the outside of the edge line on the left hand side is considered an illegal overtaking manoever
S.141 of the Transport Operations (Road Use Management—Road Rules) Regulation 1999 and all you legal eagles out there might want to have a look at S.146 & S.147. And yep coppers and emergency vehicles are exempt according to Part 19.
Now if only I could read the WH&S Act and Regulations with this kind of enthusiasm.

My misses is about to complete her Cert4 in Oh&s- so if this happens the officer in question(if it happens to me or her) will be also getting fined...

Might be in NSW, but not in Qld. Only a DEIR WH&S Inspector can fine or issue an infringement notice to the police. I have a feeling that the police have safety plans and risk assessments for these situations so they aren't in breach of the Act.

I've been searching the Legislation & Road Rules for Qld & can't find anything which specifically pertains to "filtering". Trix, the sections you note are definately a guideline & most likely could be argued in court. I think the biggest drawback is the section where it notes that 2 "bikes" can travel side by side in 1 lane, but must be 1.5m apart. This could possibly be applied to a bike slipping down the middle as it is not 1.5m from the other vehicles in the same lane. Even though the Legislation says "2 motorcycles" rather than "2 vehicles".
If anyone can find specific legislation or road rules pertaining to filtering in Queensland I'd be interested to read it.
I've sent an email to the relevent dapt asking them to point me to the sections in the legislation & also the road rules. Have had no reply as yet.

In NSW it is covered in the overtaking on the left rule I think.

Busgo is correct. It is covered in NSW and prob in other states with the prohibitions on vehicles passing on the left, not leaving enough space when overtaking, crossing unbroken lines etc.
Filtering legislation is usually specifically to allow something that is otherwise prohibited not for specifically prohibiting something.

Yeah, but what if you're not overtaking on the left? ie moving down between the traffic on the right side of another vehicle & staying within the same lane.
If you take the Qld road rules exactly to definition then this action is legal. As noted before, the only possible thing would be the 1.5m minimum distance between vehicles side by side in the same lane.

Gee Louwai your making me work for this one (thanks by the way, this helps me with the WH&S Legislation and makes me look to where I need to be and also helps if I ever need to front to the Division
Ok I surmise that if it is written in an Act or Regulation then it is mandatory i.e. you gotta play by there rules or you get fined the maximum of Penalty units. Unlike a Code of Practice which is a guideline or the minimum requirement.
Ok Section 146
"146 Driving within a single marked lane or line of traffic
(1) A driver on a multi-lane road must drive so the driver’s
vehicle is completely in a marked lane, unless the driver is—
(a) entering a part of the road of 1 kind from a part of the
road of another kind (for example, moving to or from a
service road, a shoulder of the road or emergency
stopping lane); or
(b) entering or leaving the road; or
© moving from 1 marked lane to another marked lane; or
(d) avoiding an obstruction; or
(e) obeying a traffic control device applying to the marked
lane; or
(f) permitted to drive in more than 1 marked lane under this
regulation.
Maximum penalty—20 penalty units.
and Section 147
147 Moving from 1 marked lane to another marked lane
across a continuous line separating the lanes
(1) A driver on a multi-lane road must not move from 1 marked
lane to another marked lane by crossing a continuous line
separating the lanes unless—
(a) the driver is avoiding an obstruction; or
(b) the driver is obeying a traffic control device applying to
the first marked lane; or
© the driver is permitted to drive in both marked lanes
under subsection (2); or
(d) either of the marked lanes is a special purpose lane in
which the driver is permitted to drive under this
regulation and the driver is moving to or from the
special purpose lane.
Maximum penalty—20 penalty units.
(2) A driver on a multi-lane road may move from 1 marked lane
to another marked lane by crossing a continuous line
separating the lanes if—
(a) the driver makes the move to approach or enter an
intersection from the multi-lane road and section 28(2)
or 32(2) applies to the driver for the purpose of making
the move; or
(b) the driver makes the move to approach or enter a
roundabout from the multi-lane road and section 111(8)
or (9) applies to the driver for the purpose of making the
move.
Ok so heres (in my opinion only and Im just generating discussion here) where it becomes illegal to filter when your cruising down the lane markings because your vehicle isn't completely in the lane as marked and you are not complying with any of the conditions in S.147. Yeah I'd be interested in where they get the answer for that as well.
